Overview
The purpose of this survey is to provide the U.S. Department of Education and the New York State Education Department with current information on the location and number of children living in institutions for neglected or delinquent children or in correctional institutions. The information will be used to compute the 2008-2009 Title I Neglected or Delinquent allocations for school districts so that eligible children in the institutions can be provided Title I-funded educational services.
Institutions must complete this survey in order for their eligible children to receive Title I-funded educational services during the 2008-2009 school year.

The forms are in five categories:
Each institution should submit one form for each applicable category.
An institution with more than one site will provide information from the main site of the institution, listing information for all site locations on one form in each applicable category.
Institution for Neglected Children - A public or private residential facility (other than a foster home) that is operated primarily for the care of children who have been committed to the institution, or voluntarily placed in the institution under applicable State law, because of the abandonment by, or neglect by, or death of parents.
Neglected Child Count - The total number of children
aged 5-17
residing in institutions in which the majority of the children are "neglected,"
for 30 consecutive days, at least one day of which was in the month of October
2007. Counts reflect caseload data for the 30-day timeframe that is
chosen.
Institution for Delinquent Children - A public or private residential
facility that is operated primarily for the care of children who have been
adjudicated delinquent or persons in need of supervision. The term also includes
an adult correctional institution in which children reside.
Delinquent Child Count - The total number of children aged 5-17 residing in institutions in which the majority of the children are "delinquent," for 30 consecutive days, at least one of which was in the month of October 2007. Counts reflect caseload data for the 30-day timeframe that is chosen.
Residential Facility - one in which children are under 24-hour care; children in day care facilities cannot be counted.
Operated primarily - refers to the major category of children (neglected category or delinquent category) served by the institution.
Each site is designated as either for neglected children or for delinquent children. A site cannot be both neglected and delinquent. A site with a resident population of both neglected and delinquent children must count each population category separately. The larger category, neglected or delinquent, determines the site's neglected or delinquent status. Records to substantiate the resident child count figures must be made available upon request.
The category of an institution should not change from year to year unless there has been an official change in the purpose for which the institution is operated. For example, if an institution is operated for the care of neglected children, but the majority of the children residing in the institution during October are children adjudicated to be delinquent, the institution should still be reported as an institution for neglected children until its charter or purpose is officially changed.
An institution with one or more sites in the neglected category and one or more sites in the delinquent category should submit both the form for neglected children and the form for delinquent children.
The forms require a school district to be selected for each site. Please choose the school district in which the facility is located, not where the students come from.
If a site has closed since last year’s reporting, fill out Form 3 - Residential Sites of Institutions Closed Since October 2006 so that our records remain up to date.
If a site has no eligible children during the time frame used for the survey and the facility is still in operation, please use Form 4 - Residential Sites with No Eligible Children. Indicate any sites (for either neglected or delinquent children) that are currently in operation but are not serving any eligible children during the reporting time frame. The facility will remain active in our records with a count of zero.
Students to be counted must be between the ages of 5 through 17 who reside in the facility. Committee on Special Education (CSE) placements are not eligible to be counted.
